RIVO PLUMBING

TERMS & CONDITIONS OF SALE

These terms govern work performed by Rivo Plumbing, and your use of this website. The plain-language version of the guarantee below — what it covers, how to claim, and what it excludes — is at /guarantee. The two say the same thing; this is the version that governs.

WARRANTY, REMEDIES AND TERMS OF USE

Effective on the date of the invoice.

LIMITED WARRANTY — WORKMANSHIP

Rivo Plumbing warrants its workmanship against defect for twelve (12) months from the date the covered work is completed, unless the written proposal or invoice states a longer period, in which case the longer period applies. “Workmanship” means the labor performed by Rivo Plumbing in carrying out the repair or installation.

PRODUCTS AND EQUIPMENT

Products, parts and equipment supplied and installed by Rivo Plumbing are covered by the warranty of their manufacturer, not by the workmanship warranty above. Rivo Plumbing will identify the applicable manufacturer warranty and assist the Customer in claiming under it, but the manufacturer controls coverage, exclusions and replacement procedure unless Rivo Plumbing agrees otherwise in writing.

HOW TO CLAIM

Notify Rivo Plumbing of a defect within the warranty period by telephone or in writing, describing the problem and when it appeared. Notice by telephone is sufficient; Rivo Plumbing will confirm it in writing. The Customer must allow Rivo Plumbing a reasonable opportunity to inspect the work, and reasonable access to the property to do so.

REMEDY

Where a defect in workmanship is confirmed, Rivo Plumbing will correct it at no additional labor charge. If Rivo Plumbing is unable to correct the defect after a reasonable opportunity to do so, Rivo Plumbing will, at the Customer's election, either redo the affected work or refund the amounts paid for it. The total amount recoverable under this warranty shall not exceed the amount the Customer paid Rivo Plumbing for the affected work.

WORK BY OTHERS

Costs incurred through another provider are not reimbursable unless Rivo Plumbing authorized them in writing in advance, or applicable law requires otherwise. This does not require the Customer to delay action necessary to prevent injury or property damage — see Emergencies below.

EMERGENCIES

Where there is an immediate risk of injury, flooding or property damage, the Customer should take whatever action is necessary to make the situation safe — including shutting off the water supply or gas where it is safe to do so, and contacting emergency services or the utility. Nothing in these terms requires a Customer to delay such action in order to preserve a claim.

EXCLUSIONS

This warranty does not cover: product or equipment defect, which is addressed above; normal wear of consumable items; work altered, repaired or interfered with by anyone other than Rivo Plumbing; pre-existing conditions not within the scope of the work performed; misuse or neglect; or damage caused by flood, freezing, fire, vermin, ground movement, water quality, or other causes outside Rivo Plumbing's control.

TRANSFER

This warranty extends only to the Customer named on the paid invoice and to the work identified on it. Unless the invoice states otherwise, it is not transferable to any subsequent owner or occupant of the property.

ESTIMATES AND PRICING

Prices, ranges and monthly figures shown on this website, including any produced by an online estimate tool, are indicative only and do not constitute an offer. They are based on information supplied by the Customer and cannot account for conditions that are only visible on site. The price that governs is the one stated on the written proposal or invoice the Customer accepts.

USE OF THIS WEBSITE

This website is provided for information. Its content, including service descriptions, guarantee summaries, offers and estimate tools, may change without notice, and is not professional advice for any particular property. Do not rely on it in place of an inspection. Offers are subject to their stated conditions and to availability. ATTORNEYS' FEES AND COSTS

In the event that any dispute arising out of or relating to these terms results in litigation, arbitration, or any other legal proceeding, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable attorneys' fees, court costs, expert witness fees, and other expenses incurred, including those incurred on appeal and in the enforcement or collection of any judgment, in addition to any other relief to which such party may be entitled. This clause does not limit, and shall not be read to waive, any right to recover fees or costs that the Customer has under the New Jersey Consumer Fraud Act or any other statute, and it does not apply where applicable law prohibits the recovery of fees from a consumer.

Nothing in these terms limits any right the Customer has under the New Jersey Consumer Fraud Act, or any other right that cannot be waived or limited by agreement. This warranty is in addition to those rights, not in place of them.
